These Terms govern your use of the Nomtier website, web app, iOS app, and related services. By creating an account or using Nomtier, you agree to these Terms and acknowledge the Privacy Policy.
Eligibility and beta access
You must be at least 13 years old to use Nomtier. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must review and agree to these Terms for you.
Nomtier may be invite-only or offered as a beta. Access can be limited, changed, suspended, or ended. Beta features may be incomplete, change without notice, or lose data. Do not use the beta as the only copy of information you cannot replace.
Your account
Provide accurate account information, protect your credentials, and tell us promptly if you believe your account has been compromised. To the extent permitted by law, you are responsible for activity performed through your account.
Your content
You keep ownership of content you submit, including journal entries, lists, ratings, photos, profile information, and place corrections. You grant Nomtier a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical purposes, display, and distribute that content only as needed to operate, improve, secure, moderate, and provide Nomtier according to your sharing choices.
You represent that you have the rights and permissions needed to submit your content. Do not upload confidential information, content that violates another person's rights, or images of people without any permission required by law.
Factual place contributions may be reviewed, corrected, merged with other sources, or displayed to other users. Nomtier may remove or limit content that violates these Terms or creates legal, security, or safety risk.
Acceptable use
You may not:
- Use Nomtier unlawfully or to harass, threaten, impersonate, exploit, or deceive anyone.
- Post illegal, abusive, hateful, sexually exploitative, infringing, or malicious content.
- Probe, bypass, disable, or interfere with security, authentication, rate limits, or service operation.
- Use automated collection, scraping, or bulk access against Nomtier without written permission.
- Upload malware or attempt to gain unauthorized access to accounts, data, or systems.
- Misrepresent restaurant information, manipulate rankings, or coordinate fraudulent activity.
Restaurant and map information
Place names, locations, hours, categories, prices, menu signals, accessibility details, and other venue information may be incomplete, delayed, or inaccurate. Confirm important details with the venue.
Nomtier is not a medical, allergy, nutrition, or food-safety service. Do not rely on tags, photos, reviews, or recommendations to determine whether food is safe for a dietary restriction or allergy.
Third-party services
Nomtier uses or links to services operated by others, including map, authentication, email, push-notification, hosting, and storage providers. Their own terms and privacy policies apply to their services. Nomtier is not responsible for third-party content or services outside its control.
Nomtier's rights
Nomtier and its licensors own the service, software, branding, interface, and documentation, excluding your content and third-party data. These Terms do not grant you rights to use Nomtier's trademarks or copy, modify, distribute, sell, or reverse engineer the service except where applicable law does not permit that restriction.
Suspension and termination
You may stop using Nomtier at any time. We may suspend or terminate access when reasonably necessary to protect users or the service, enforce these Terms, comply with law, or respond to abuse. Sections that by their nature should continue after termination remain in effect.
Disclaimers
To the fullest extent permitted by law, Nomtier is provided "as is" and "as available." We do not promise uninterrupted availability, error-free operation, complete data, or that recommendations will match your preferences. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Nomtier will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, goodwill, or business opportunity arising from your use of the service. Nomtier's total liability for claims relating to the service will not exceed the greater of $100 or the amount you paid Nomtier during the 12 months before the claim. This does not limit liability that cannot be limited by law.
Changes and contact
We may update these Terms as the service changes. We will update the date above and provide additional notice when required. Continued use after updated Terms take effect means you accept them, except where law requires another form of consent.
